This is our largest in-person conference with close to 300 participants, so you are welcome to stop in and pick up your nametag early and then explore the hotel/surrounding areas before opening remarks.

The line tends to get pretty long at 15 minutes prior to the opening remarks so we encourage folks to stop in early.

In the first of our small groups we will introduce ourselves and describe the dynamics of where we work as part of defense teams. We will meet our colleagues and introduce the ways in which we practice as social workers, sentencing advocates, case coordinators, reentry coordinators, and the other roles we have in public defender offices, identifying the strengths and challenges of our programs and learning how other programs utilize their social workers/sentencing advocates in an interdisciplinary setting. We will also discuss common issues and goals for the week.

With billions of cell phones in the world and millions of phone applications, the amount of evidence created by cell phones can be daunting. This program will explain the common types of evidence that can be recovered from cell phones, including deleted data. Some evidence types that will be discussed include location information, text messages, multimedia, voice mails, cloud backups, and more. Real-life case examples will be used to illustrate how evidence recovered from cell phones can be used in cases and investigations. The proper methods to forensically acquire cell phone evidence will be covered, and how evidence can be challenged in court.

Cellebrite Cell Phone Examination
Cellebrite is the most utilized mobile device forensic tool in the world.  In this class, attendees will be guided through the extracted data from mobile devices from within Cellebrite forensic software live.  During this lesson, participants will be educated on the forensic artifacts that can be recovered from a mobile phone and how that data is relevant to cases. Representing Muslim Clients
Islam is the fastest growing religion in the world, currently there are about 1.8 billion Muslims worldwide, making up over 24% of the world population. By 2025, Islam is expected to grow by 50%.
By some counts, there are between 6-8 million Muslims in the United States and about 50% of them are Africans born in America. So, these statistics indicate that at some point our clients will be Muslim. And occasionally lawyers and investigators that are incompetent, underfunded and openly bigoted represent them. A lack of cultural sensitivity to other ethnic groups and or religions may affect their ability to adequately prepare for a case.
This session will provide information helpful in dealing with Muslim clients that were arrested as Muslims, as well as those that converted to Islam in jail after their arrest.

This small group focuses on the importance of using best practices to ask critical questions about an individual's social history, life history, experiences, strengths, challenges, and goals during an interview to determine the best ways to understand - then translate - that individual's circumstances into a compelling and empathic report. We will draw on best practices for interviewing that include listening for the interviewee’s perspective on and experience of race, culture, class, environment, identity, role, and structure in society to develop a more complete assessment of their biopsychosocial history. We will discuss ways in which this information can be used to create a thematic and compelling report about the individual client’s experiences, past, present, and future. Role playing and practice writing will be part of small group work.

Introduction to Digital Forensics
This class will explain the evolution of computer forensics into what is now known as digital forensics. As a part of this class, attorneys will learn about the foundations of digital forensics, including how digital evidence should be collected, forensically acquired (copied), preserved, examined, and analyzed. The class then uses numerous case examples to explain different forensic artifacts and how they can be used in cases. Evidence types include metadata, internet history, communication artifacts, searches, multimedia, location evidence, and much more. Actual case examples are utilized to illustrate the usefulness of these forensic artifacts in litigation. Attorneys will also learn the difference between an information technology expert and a digital forensics expert, with case examples illustrating the problematic outcomes of having information technology experts attempting to testify about digital forensics.

Racial Injustice and Our Role
If the defense community is to come to terms with racial injustice, we must also come to terms with the ways in which our work contributes to racial injustice.

Subtle harm is done in the standard practices of our day-to-day work. When we show up unannounced at the home of a Native witness, we deny that witness the common courtesies---requesting consent for a meeting and making an appointment----that we afford our friends and colleagues. When a white investigator arrives at the home of a Latinx family and asks to be let in, that investigator is wielding their whiteness to exercise power over the Latinx family, and undermining their sense of safety in their home. This may be unavoidable in some instances---for instance when dropping in on a government witness---but avoidable in others---perhaps when interviewing a friendly mitigation witness. In any case, teams should be including an analysis of their racial impact when deciding what tactics to employ.

Racism arises in our defense themes as well. When a mitigation narrative describes a Black defendant who was raised in a Black community, as living in a “gang ridden” neighborhood, “rife with violence and crime,” we pathologize the Black community while ignoring the deep historical racist structures that created those conditions. The racial disparities in the criminal-law system exacerbates the harm. When defenders pressure our client’s mother, who is likely to be Black or Brown, to testify at sentencing about her failings as a parent in front of an audience that is likely to be disproportionately white, we reinforce the belief that white people are entitled to sit in judgment of people of color. We may chose to employ these tactics, but might also lessen the racist impact by including in our narratives a discussion of the impact of historical and institutional racism.
There may or may not be valid reasons for the defense community to continue to engage in these tactics, despite the harm at they cause. But if we aspire to combat racism, and if we claim to fight for justice, we must examine our practices and consider whether they are worth the cost.

Voluntary Brain Disease? Substance Use Disorder, Neurobiological Effects, and Mitigating Factors
In many legal jurisdictions substance use is a voluntary act that may result in mental impairment that does not mitigate legal consequences for the substance using individual. This session will introduce the ways in which substance use disorder is a brain disease, providing information about the physical and neurobiological effects of different substances on the brain and how these may result in individual impairment. The various ways in which substances can impact an individual and how this information can be used to develop mitigation will be brainstormed during the session. Recent legal cases related to substance use and the role of the individual will be discussed.

Communicating in relationships can be hard. We've all been in the situation when a call, email, or in-person conversation gets contentious and has the potential to blow up into a confrontation or develop into an ongoing issue. Many of us are hesitant or uncertain when it comes to addressing conflict in relationships.  In this workshop, we will work together through a series of scenarios to discuss ways to more effectively hear one another and acknowledge our feelings and needs in any given situation. Rather than just getting what we want, the goal is to create a connection that leads to compassionate understanding. It is from this place that creative resolution can take place.
